GST Nil Return Filing: Who Needs to File a Nil Return in GST and How

Illustration of a business professional efficiently filing a GST nil return online on a laptop

A GST registration is, in effect, an undertaking to complete GST return filing for each tax period, whether or not the business has traded. The manual from the GST portal itself states that a nil return is a return filed when there is no outward supply and no inward supply to declare in that period.

It is often these businesses, presuming that “nothing happened, so nothing needs filing,” that end up with late fees, blocked filings, and notices waiting for them. This step-by-step guide explains the practicalities of filing a GST nil return, the essential criteria, and the filing process online and via SMS.

What Is GST Nil Return Filing and Who Needs to File It?

Nil status is related to the tax period, and not towards the taxpayers. The same GSTIN can have a nil position in one month and a fully taxable position in the next, so make sure to see the situation on a period-by-period basis and not as a one-off event.

What Makes a Return Nil in GST?

  • No outward supplies. Since there are no sales invoices, debit notes, or export documents to be reported, all tables for outward supplies in GSTR-1 will be blank.
  • No inward supplies. There are no purchases or credit notes from vendors, and nothing flows into the inward supply tables.
  • No tax liability. There is nothing payable under forward charge or reverse charge, bringing the liability columns of the summary return to nil.

Who Must File a Nil GST Return?

For every registration, every taxpayer under GST must file a nil return even if no transactions occurred in that period. Because a zero return is triggered by registration and not turnover. It is applicable to regular taxpayers, dormant registrations held for future use, and businesses being kept alive or when an application for GST cancellation is pending. Each of them needs to file a nil return.

How to File GSTR 1 Nil Return Monthly

GSTR-1 is the statement of outward supplies, and for monthly filers, it is due on the 11th of the next month. Even for a month during which no invoices are raised, the return has to be filed as a Nil return, since the statute does not give the option of not filing a return for a lack of sales. The invoice furnishing facility does not come into play at this stage, as the exercise is simply logging in and declaring nil.

Why Is My Nil GSTR-1 Filing Blocked?

As per the official GST manual, before the nil GSTR-1 of the current period is submitted, GSTR-1 and GSTR-3B of the previous period need to be filed. If a previous month is still not filed, the portal will not allow you to proceed. Settle the payable late fees for that prior period, and only then can you proceed to file the current period.

How Do I File a Nil GST Return?

A nil return will be submitted through the same route as a normal return, with zero figures instead of actual figures. Ensure you have your GST number and portal login details, the registered mobile number for the EVC one-time password and the financial year and return filing period for which you are filing the return.

How Do I File a Nil Return Step by Step?

  1. Log in to the GST portal. Provide your GSTIN credentials, enter the captcha, and you land on the dashboard of pending returns.
  2. Determine the financial year and period. Pick the precise return filing period the return is filed for, as selecting an erroneous period is by far the most common cause of figures being plotted in the wrong month.
  3. Open the GSTR-1 tile. Select the nil return option for this period and file the return without any invoice data.
  4. Verify using EVC or DSC. An OTP is sent to your registered mobile number or email address. The return is filed only after you complete this step.
  5. Repeat for GSTR-3B. File the summary return for the same period, then write down the ARN generated for both returns and save it.

Can I File a Nil Return in GST Through SMS?

Yes. Through this facility, taxpayers intending to file Nil GSTR-1 and Nil GSTR-3B can do so from their registered mobile number by sending a pre-specified SMS to number 14409 (without login). Intending taxpayers need to meet a couple of eligibility conditions that are also required for uploading Nil GSTR-1 and Nil GSTR-3B online, i.e., shall have no liability for the period of return and must have filed the returns of the previous period. The ARN is received via SMS.

Is GSTR-3B Compulsory for Nil Return?

Yes, GSTR-3B is the self-assessed summary return, which includes the step to pay the tax, and it needs to be filed for all tax periods, regardless of any business happening or not. There is no exemption for a return with nil liability. Skipping it does not create a clean slate – the late fee keeps accruing, and a pending GSTR-3B blocks every subsequent period return, including a legitimate nil return you want to file today.

GST Nil Return Late Fee and Its Consequences

A late fee is levied under Section 47 solely for delay in filing regardless of the fact whether there was any tax payable or not. For nil returns, where tax payable was NIL, it is at a reduced rate of (CGST ₹10/day + SGST ₹10/day) i.e., ₹20 per day in total with a limit of ₹250 per Act or ₹500 per return. Since the late fee is levied per return, if the taxpayer has GSTR-1 and GSTR-3B both unfiled, they will be required to pay the late fee twice per period. Yet, the applicable late fee would be lower.

Does Interest Apply on a Nil GST Return?

No. Interest is levied only on late tax payments, and a nil return has no tax to pay. The true cost of not filing a nil return is the late fee, and the effect on future filings, and deregistration of the filing block.

Quick Checklist for GST Nil Return Filing

  • Verify the period did not have outward supplies, inward supplies, and liability.
  • Confirm that the GSTR-1 and GSTR-3B of the previous period have been filed.
  • Check deadlines: 11th for GSTR-1 and 20th for GSTR-3B for monthly filers.
  • Submit with the valid GSTIN and choose the proper financial year and period.
  • Make a zero balance declaration on the portal, or alternatively, use the SMS route to 14409 if permitted.
  • Authenticate with EVC or DSC and save the ARN for each return filed.

The obligation to file does not pause when business does. However, handling a nil period into a ‘non-event’ is what can bring late fees, block filings, and a messy exit.

Foxtax enables registered businesses to track their due dates and complete their nil returns on time, so that a quiet month remains a quiet month. If you’d prefer to hand your compliance calendar over to a team that keeps an eye on it for you, Foxtax can deal with the entire GST filing process.

FAQ

Do I need to file a nil GST return every month if my business is shut?

Yes, as long as the registration is not formally cancelled. A dormant or shut business is still registered for tax, because of this, returns are still due for each period, even with zero business activity.

What do I need to file a nil return?

Your GSTIN or portal user ID and password, access to the registered mobile number or email for the EVC OTP, and the correct financial year and return filing period.

Can I file a nil return for a past period after the due date?

Yes, returns can be filed late and the portal will levy the late fee when filed for a period. However, all past periods need to be closed for the next current period to be filed.

Can a nil return be revised later?

A filed return cannot be modified or revised. Any missed transaction must be reported in the return of the next period, and GSTR-1 has a specific amendment table indicating the correction to be made for the previous periods.
