All Indians on the payroll with a PF deduction on their payslips are members of a setup that starts not with the employee but with the employer. Once a firm passes a certain size threshold, under the Employees’ Provident Fund & Miscellaneous Provisions Act 1952 it has a legal obligation to register with the EPFO – and coverage, in practical terms, begins at that point and applies to all but the highest earners.
EPF Registration Eligibility: who must register, who is covered, and what paperwork they require. Get it wrong, and you could be liable for damages of as much as 100% of arrears due to the provision’s default penalty.
What Is EPF Registration Eligibility?
EPF registration eligibility is the test that decides whether a business must obtain an EPF code from EPFO and begin deducting 12% of covered employees’ wages. It is an establishment-level test, not an employee-level one: the business qualifies first, and individual coverage follows automatically. Two variables govern the answer, the nature of the establishment and the number of persons employed.
Which Establishments Cross the 20-Employee Threshold?
- Factories in Schedule I industries. If a factory is in an industry specified in Schedule I of the Act and if 20 or more people are usually employed, the Factory Act of Schedule I will apply. The factory includes all persons concerned.
- All notified establishments. All establishments notified by the Central Government with 20 or more persons are covered. An establishment shall continue to be covered under the Act, even if after being notified, the number of persons employed therein falls below 20.
- Contract and casual labour count. Where the threshold is measured on persons employed, contract workers connected to the work of the business are included. This is the most common non-compliance gap that we have seen.
They are the basis for everything else in this article in respect of EPFs.
Is EPF Registration Compulsory for Every Business, or Can It Be Voluntary?
No, it is not mandatory. Less than 20 employees, voluntary. Under Section 1(4) of the Act an establishment may obtain voluntary coverage with the consent of the employees and approval of the Central PF Commissioner. This can often be commercially prudent as most corporate clients and some tender documents now view an EPF code as an indicator of formal employment practices.
Getting the picture on this voluntary pathway explains why EPF registration can be threshold-based.
EPF Eligibility Criteria for Employees
When the business is covered, EPF eligibility criteria shift to the individual, and the operative variable becomes PF wages (that is, basic wage plus dearness allowance and retaining allowance).
What Is the Wage Ceiling and Who Is an Excluded Employee?
All employees drawing PF wages of up to ₹15,000 per month at the time of joining must be enrolled. All employees earning more than ₹15,000/month then constitute an “excluded employee” who can be left outside the fund unless the company and employee decide otherwise through written agreement. The rule is “once a member, always a member”: no matter when he crosses the limit, an existing PF member continues to be covered, and a joiner who was already a member elsewhere must be enrolled.
Are International Workers and Minors Covered?
Foreigners are covered, despite the ₹15,000 limit. Nationals from countries with a Social Security Agreement with India can file a Certificate of Coverage to be exempt from EPF for the period of agreement. Even minors are covered: EPFO allows a minor youth who is above age 14 to be enrolled with a guardianship certificate and consent, which is significant in shop-floor or apprentice-level hiring.
These employee-side rules will round out the picture of eligibility first created by the establishment test.
EPF Rules for Employees Once Registration Is Done
“Registration” is only the beginning, not the end. Three recurring responsibilities under the EPF rules for employees are there every month.
- Contribution split. The employee deposits 12% of PF wages and the employer contributes 8.33% of the employer’s share to the pension fund and 3.67% to the EPF, and on top of this, 0.5% for the EDLI and 0.5% admin charges.
- Generation of UAN. For each new joiner, a UAN has to be generated and seeded with Aadhaar and bank details before first remittance.
- ECR filing. The Electronic Challan cum Return must be uploaded by the 15th of the next month and paid, else on delay, attract interest and damages as per the Act.
This is where most otherwise-eligible employers default on these operational rules.
How Business Type Affects Your EPF Registration Requirement
This 20-person test is the same for a proprietorship, a partnership, an LLP, a private limited company, a cooperative or factory. Structure does not alter the coverage but does alter the paperwork that establishes the entity.
- Company — offers the CIN and certificate of incorporation signed by an authorised signatory, using DSC and DIN.
- LLP or partnership firm – gives the LLPIN or partnership deed as registered.
- Proprietorship — PAN of the establishment should be used, a trade licence or Shops & Establishments registration number.
- Factory — includes Factories Act licence with occupancy or building permissions.
Identify your entity type early so documents are not rejected at the portal.
EPF Registration Requirement: Documents to Keep Ready
The company portal of EPFO demands all the documents; incomplete documents lead to the highest rejection of applications.
- Establishment identity — PAN of the establishment, with proof of incorporation, LLP, or partnership.
- Bank proof — cancelled cheque or statement of the company account.
- Address and occupancy proof — electricity bill, rent agreement, or property ownership deed.
- Details of the employees and their salaries — salary register for the first month and details of joiners.
- Digital signature — DSC of the authorised signatory, compulsory for filing.
A complete file reduces approval times, eliminates the need for resubmission.
Quick Checklist for EPF Registration Eligibility
- Registration required if 20 or more persons are employed? Yes.
- Will it be a Factory in a Schedule I industry? Same rule of 20 persons.
- Less than 20? Voluntary registration under Section 1(4).

Remember, the Code on Social Security, 2020 has been enacted, but the 1952 Act still applies until the new Code is fully implemented, so check the current status with your Regional PF Commissioner. Frequently Asked Questions
Who is eligible for Startup India registration, and does it affect EPF?
This registration is distinct from the DPIIT scheme of Startup India registration, which is available to private limited companies, LLPs registered, etc within the limits of age and turnover. This registration does not impact the EPF registration eligibility as it depends on the number of people and the type of setup.
Can a 14-year-old be a CEO, and can a minor be an EPF member?
It is illegal for a 14-year-old to be a director or CEO of a company since the Companies Act stipulates 18 as the minimum age. Though, a young employee (14 and above) can be engaged in safe work and registered with EPF with the guardian’s approval.
What are the requirements for company registration in India compared with EPF registration?
The company registration in India is filed with the MCA portal via SPICe+ registration, including DIN DSC MOA, AOA and registered office. EPF registration is a subsequent, separate EPFO filing on the EPFO portal using the incorporation certificate plus PAN, bank certificate, and salary information.
Do I need a separate EPF code for each branch?
Not automatically. Generally, a single legal entity has one code with branch information maintained in the establishment master. When it comes to a branch as an independently covered establishment, EPFO may require a fresh registration – check your position locally.
What happens if an eligible establishment never registers with EPFO?
EPFO can also impose damages (Section 14B) and interest (Section 7Q), prosecute under Section 14 and recover arrears representing the employee. Even if not registered, the liability remains, it just keeps adding up.
